The 3rd Supplementary Report to the United Nations produced by the Italian NGO Group for the CRC was published on December 2017 in Italian and translated into English on February 2018.

The Report is an abridged version of the Italian version, the analysis of the context and phenomenological aspects have been shortened, the notes containing references to documents or websites exclusively in Italian have been eliminated,”.

1st SUPPLEMENTARY REPORT TO THE UNITED NATIONS

 

The 1st Supplementary Report to the United Nations produced by the Italian NGO Group for the CRC was published on November 2001 in Italian and translated into English on October 2002.

The Supplementary Report is a tool through which the Third Sector expresses its opinion on the implementation of the principles embodied in the Convention on the Rights of the Child (CRC).

The report is the result of an important debate and dialogue within the Italian Third Sector, where for the first time, consensus has been reached in analyzing the rights of children in the State. It represents a summary of the many contributions and perspectives offered by the organizations and associations that work with and for children in Italy. It represents the first step toward the creation of a common platform for independent monitoring of the implementation of the CRC.

 

SUPPLEMENTARY REPORT ON THE IMPLEMENTATION OF THE OPTIONAL PROTOCOLS ON THE CRC IN ITALY

 

In 2005 the Italian NGO Group for the CRC presented the Supplementary Report on the implementation of the two CRC Optional Protocols, submitted to the UN CRC Committee and discussed during the pre-session of the 6th October.

 

MONITORING PROCESS OF THE CONVENTION ON THE ELIMINATION OF RACIAL DICSRIMINATION

 

In 2008 and 2012 the Italian NGO Group for the CRC contributed to the monitoring process of the Convention on the Elimination of Racial Discrimination.

In 2012 a delegation of the Italian NGO Group for the CRC, together with the Italian Committee for the Promotion and Protection of Human Rights, the members of the Committee, during a Lunch Time Briefing, to present an extract of the 3rd CRC Report adressing the issue of racial discrimination against children.

 

 

UNIVERSAL PERIODIC REVIEW (UPR)

 

In 2009 and 2014 the NGO Group for the CRC sent to the UN its contribute to the Universal Periodic Review (UPR), which is an examination procedure established by the UN General Assembly with the objective to evaluate periodically the 192 UN countries’ achievements in the field of protection and promotion of human rights.

The Group, specifically, sent to the OHCHR a document containing all the informations regarding the status of implementation of Children’s rights in Italy.

 

6th REGIONAL MEETING OF NGOs CHILDREN’S RIGHTS COALITION IN EUROPE OUTCOME DOCUMENT

 

In 2010 the Italian NGO Group for the CRC organised the 6th Regional Meeting in Florence. Almost 70 delegates from 32 European countries took part to the meeting

 

Italian Government Reports to the CRC

 

Under article 44, paragraph 1 (a), of the Convention on the Rights of the Child (CRC) the State Party should submitt to the Committee on the Rights of the Child (CRC) a periodic report on the implementation of the Convention every five years, within two years after the Convention has entered into force for the State party concerned.

Italy has ratified the CRC with Law 176/1991 and at the moment Italy has presented the following Peiodic Reports:

CONVENTION ON THE RIGHTS OF THE CHILD (CRC)

 

The United Nations General Assembly adopted the Convention on the Rights of the Child (CRC) and opened it for signature on 20 November 1989 (the 30th anniversary of its Declaration of the Rights of the Child).

It came into force on 2 September 1990, after it was ratified by the required number of nations.

Italy has ratified the CRC through Law n. 176 of 1991. For more information, click here

 

OPTIONAL PROTOCOLS

 

Three Optional Protocols to the Convention on the Rights of the Child were adopted:

The firsts two Optional Protocols were adopted by the United Nations General Assembly on the 25th May 2000 and came into force three months later: OPAC on 18th January 2002 and OPSC on 12th February 2002. The last one, OPIC, was adopted by the United Nations General Assembly on the 19th December 2011 and came into force the 14th January 2014.

Italy has ratified the three of them, OPAC and OPSC on the 13th March 2011 and OPIC on the 4th November 2015.

 

SUMMARY RECORDS: Meetings between Committee on the Rights of the Child and Italian Government rappresentatives

 

The State party report is usually discussed in public meetings of the Committee on the Rights of the Child (UN CRC Committee), during which both the State representatives and Committee members take the floor. Relevant United Nations bodies and agencies are represented. During these meetings Summary records are produced.

 

LIST OF ISSUES RAISED BY UN CRC COMMITTEE TO ITALY

 

The UN CRC Committee, at the end of the pre-session, may send to the respective Government through diplomatic channels a List of Issues.

 

ITALIAN GOVERNMENT REPLY TO LIST OF ISSUES

 

In order to facilitate the efficiency of the dialogue, the UN CRC Committee requests the State party to provide the answers to its List of Issues in writing and in advance of the session, in time for them to be translated into the working languages of the UN CRC Committee.

 

CONCLUDING OBSERVATIONS OF THE COMMITTEE ON THE RIGHTS OF THE CHILD

 

The Concluding Observations include suggestions and recommendations to the State Party on the implementation of the Convention on the Rights of the Child made by the UN CRC Committee and contain the following aspects: introduction; positive aspects (including progress achieved); factors and difficulties impeding the implementation; principal subjects for concern; suggestions and recommendations addressed to the State party.

The Concluding Observations are made public on the last day of a Committee session during the adoption of the report, of which they form a part. Once adopted, they are made available to the States parties concerned, and also issued as official documents of the UN CRC Committee.

At present the UN CRC Committe has concluded the exam of 5 Government Reports presented by Italy, three regarding the implementation of the CRC (in 1995, 2003 and 2011) and the other two regarding the Optional Protocols (2006):

GUIDELINES FOR THE STATE PARTY REPORTS

 

UN CRC Committee has aimed at structuring the reporting process and the dialogue with the State party in such a way that issues of principal concern are dealt with in a methodical and informative manner. For this purpose the Committee has prepared guidelines regarding the form and content of initial reports and periodic reports on the CRC and the Optional Protocols.

These guidelines are public and have been disseminated to all States parties concerned.

 

GUIDELINES FOR NGO REPORTS

 

Under article 45, paragraph (a), of the CRC “The Committee may invite the specialized agencies, the United Nations Children’s Fund and other competent bodies as it may consider appropriate to provide expert advice on the implementation of the Convention in areas falling within the scope of their respective mandates. […] to submit reports on the implementation of the Convention in areas falling within the scope of their activities”.

These Reports are defined as supplementary to the Governmental Report.

Committee on the Rights of the Child has also produced Guidelines for the participation of NGOs and individual experts in the pre-session working group of the UN CRC Committee.
